Planning Permission for Summer houses

Adding a summer house to your garden is one of the easiest ways to create extra space at home. Whether you’re planning a garden office, studio, or relaxing retreat, many summer houses can be installed without the need for planning permission.

However, planning rules can vary depending on the size, location, and how the building will be used. This guide explains when planning permission is usually required and when your summer house may fall under permitted development rights.

Do You Need Planning Permission for a Summer House?

In many cases, planning permission is not required for a summer house if it is placed within the garden of your home and used for purposes related to the main property.

Summer houses are typically considered outbuildings, which means they can often be built under permitted development rules.

Your summer house usually won’t require planning permission if:

  • It is located within the curtilage (garden area) of your home

  • It is used for purposes incidental to the house (such as a garden office, gym, or hobby space)

  • It does not exceed permitted development size or height limits

  • It is not used as a separate living accommodation

Many homeowners install summer houses as:

  • Garden offices

  • Creative studios

  • Home gyms

  • Relaxation spaces

  • Guest garden rooms

As long as the structure remains secondary to the main house, planning permission is often not required.

Summer House Permitted Development Rules

Most summer houses fall within permitted development if they meet the following guidelines.

Location

The summer house must be located behind the main house and within your private garden.

Summer houses are generally not permitted in front of the principal elevation of the property facing the road.

Height Restrictions

The maximum height allowed depends on the roof type.

  • Flat roof: up to 2.5 metres high

  • Dual-pitched roof: up to 4 metres high

  • Single-pitched roof: up to 3 metres high

If the summer house is located within 2 metres of a boundary, the total height must not exceed 2.5 metres.

Size Limits

Summer houses must not take up more than 50% of the total land surrounding the original house.

This includes all extensions, sheds, and other garden buildings.

Use Restrictions

A summer house built under permitted development cannot be used as a self-contained living space.

This means it should not include:

  • Permanent sleeping accommodation

  • Full kitchens

  • Independent residential use

It must remain a structure used in connection with the main house.

When Planning Permission May Be Required

Planning permission may be required in certain situations.

This can include:

  • Using the summer house as independent accommodation

  • Running a business that creates regular visitors or employees

  • Installing a large building that exceeds permitted development limits

  • Building within the grounds of a listed building

  • Installing a summer house in a conservation area, national park, or Area of Outstanding Natural Beauty

Local councils may also have additional restrictions depending on your property location.

Summer Houses for Garden Offices

One of the most popular uses for a summer house is a garden office.

In most cases, a garden office does not require planning permission as long as it meets permitted development rules and remains secondary to the main property.

Many homeowners choose insulated summer houses to create comfortable workspaces separate from the main house.
